Immigration Appeals & Judicial Review

Expert representation at immigration tribunals and judicial review proceedings to challenge unfair Home Office decisions.

A refusal of your immigration application does not have to be the end of the road. At Kings Court Law, our specialist litigators have extensive experience challenging Home Office decisions through the appeals process and judicial review. We fight tenaciously to protect our clients' rights and secure the outcomes they deserve.

Types of Immigration Appeals

First-tier Tribunal (IAC)

The first level of appeal for most immigration decisions. Hearings are conducted before an Immigration Judge who will consider the evidence and legal arguments.

Upper Tribunal (IAC)

Appeals from the First-tier Tribunal on points of law. Permission must be obtained before an Upper Tribunal appeal can proceed.

Court of Appeal

Further appeals from the Upper Tribunal on significant points of law. Permission required.

Judicial Review

A challenge to the lawfulness of a public body's decision in the High Court. Used when there is no right of appeal or when the decision-making process was unlawful.

Grounds for Appeal

  • The decision is not in accordance with the Immigration Rules
  • The decision breaches the applicant's human rights (Article 8 ECHR — right to family life)
  • The decision is unlawful under the Equality Act 2010
  • The decision is contrary to the UK's obligations under the Refugee Convention
  • The decision-maker made an error of law or failed to consider relevant evidence
  • The decision was procedurally unfair or the applicant was not given a fair hearing

Judicial Review

Judicial review is a powerful tool for challenging unlawful Home Office decisions where there is no right of appeal or where the appeal process has been exhausted. It is a complex area of law that requires specialist expertise.

  • Challenging unlawful detention and seeking bail
  • Challenging removal directions and deportation orders
  • Challenging decisions where there is no right of appeal
  • Seeking injunctions to prevent removal pending further proceedings
  • Challenging delays in decision-making by the Home Office
